Throughout his career, Judge Sontchi has been engaged in evaluating companies’ actions in insolvency situations. Navigating a company through bankruptcy is complex and requires knowledge and experience. Judge Sontchi has 20 years of judicial
experience overseeing complex reorganizations, many of which involved conflict situations.

Judge Sontchi recently completed an assignment as a member of a 2-person special committee, in which he and his co-director had sole responsibility for supervising a 9-month marketing process that ultimately led to a transaction valued at $1.4 billion. In addition, the special committee was vested with sole authority over conflict matters involving the equity holders. The special committee conducted a thorough investigation of possible causes of action and ultimately reached a favorable settlement.

Currently, Judge Sontchi is the sole member of several LLCs in Chapter 11 in Delaware. He was responsible for the successful marketing and sale of the debtors’ sole asset – a partially completed luxury development project in California. Efforts to resolve the case consensually continue.

Judge Sontchi is a leading jurist and scholar in insolvency and, since retiring from the Delaware bench, has been retained on numerous occasions as an expert. Judge Sontchi has written more than 200 opinions, as well as many scholarly articles.

In addition to his years of experience as a teacher and writer, he has testified before Congress on insolvency issues. In short, Judge Sontchi not only knows the law, he knows how to explain even the most complex issues in a clear, concise, and understandable manner. As such, he is well-suited to provide expert opinions on insolvency issues.

While many of his assignments have been confidential, he has been publicly engaged as an expert in US bankruptcy law in a sanction hearing in the U.K., as a defense expert in a malpractice case in Texas state court on issues relating to the conduct of a Chapter 11 case in Delaware, and as an expert on bidding procedures relating to the sale of certain assets of CITGO pending in the Delaware District Court.
